General Terms and Conditions Pinewood Cabins
Article 1: Definitions
- The entrepreneur: Pinewood Cabins – Drosbacken 901, 797 92 Idre
- The guest: the person who has entered into an agreement with the entrepreneur regarding a place for a specific period. Co-guests are the other persons indicated in the agreement.
- Third party: any other person who is not the guest and/or co-guests.
- Place: a spot for a camping accommodation at Pinewood cabins that has been agreed upon between the guest and the entrepreneur.
- Accommodation: cabins
- The agreement: the arrangement between the guest and the entrepreneur regarding the right to use a place for a previously agreed compensation and period.
- Information: written or electronic data about the use of the place, the accommodation, the facilities, and the rules of Pinewood Cabins.
- Cancellation: written termination of the agreement by the guest before the start date of the stay.
- Regulations: the written rules for the use of the grounds and facilities.
Article 2: Duration of the Agreement
- The agreement expires after the agreed period without requiring notice.
Article 3: Price and Price Changes
- The price is agreed upon based on the price list established by the entrepreneur.
- If after establishing the price list, additional costs arise due to increased government charges, these extra costs can be passed on to the guest, even after concluding the agreement (For example, in case of VAT increase).
Article 4: Additional Costs
- Bed linen. Use of bed linen in rental accommodations is mandatory (duvets and pillows provided). Rental is possible at a rate of SEK 100 per person.
- Final cleaning. The quality of the final cleaning performed by yourself will be checked before departure. If this is deemed insufficient by a staff member of Pinewood Cabins, you will have the opportunity to rectify this or choose to have us perform it. In the latter case, the above-mentioned final cleaning costs will still be charged.
Article 5: Reservation
- Reservations can be made both by phone and online.
- After receiving the reservation, you will receive a reservation confirmation/invoice by email.
- For reservations more than 28 days before arrival, a standard reflection period of 2 days applies. For reservations within 28 days before arrival, no reflection period applies.
- On the third day after reservation, your booking becomes legally binding, and Articles 6 and 7 of these general terms regarding changes and cancellation apply.
Article 6: Payment
- The guest must make the payment in Swedish kronor, observing the agreed terms.
- Payment must be made in two installments:
• 2 weeks after telephone, written, or electronic reservation, the first installment of 50% of the agreed amount.
• 30 days before the start of the stay, the second installment must be available to the entrepreneur. - If reserved less than 30 days before the arrival date, payment must be made in one installment simultaneously with the reservation.
- If on the day of arrival, the entrepreneur is not in possession of the total amount due, the entrepreneur is entitled to deny the guest access to the grounds, without prejudice to the entrepreneur’s right to full payment of the agreed price.
- If the total amount is not paid on time, after written notice, an interest rate of 1% per month will be charged on the outstanding amount. The reasonable extrajudicial costs incurred by the entrepreneur after notice of default shall be borne by the guest.
Article 7: Cancellation
In case of cancellation, the guest pays compensation to the entrepreneur, which amounts to:
- for cancellation more than 2 months before the start date, 80% of the agreed price;
- for cancellation within 2 months before the start date, 90% of the agreed price;
- for cancellation within 1 month before the start date, 100% of the agreed price;
- for cancellation within 2 weeks before the start date, 100% of the agreed price.
- The compensation will be refunded proportionally, after deduction of administrative costs amounting to SEK 150, if the place is reserved by a third party at the suggestion of the guest and with written consent of the entrepreneur for the same period or a part thereof.
Article 8: Use by Third Parties
- Use by third parties of an accommodation and/or associated place is only permitted if the entrepreneur has given written permission.
Article 9: Maximum Number of Persons Allowed
1. Occupancy with more than the maximum allowed number of persons is not permitted.
Article 10: Late Arrival and Early Departure
- The guest is liable for the full price of the agreement for the entire agreed period.
Article 11: Interim Termination of the Agreement by the Entrepreneur and Evacuation
The entrepreneur can terminate the agreement with immediate effect:
- if the guest, co-guest(s) and/or third parties fail to fulfill obligations from the agreement, regulations, and/or government regulations, despite previous verbal and/or written warnings, to such an extent that according to standards of reasonableness and fairness, the entrepreneur cannot be expected to continue the agreement;
- if the guest, co-guest(s), despite previous verbal and/or written warnings, cause nuisance to the entrepreneur and/or other guests, or spoil the good atmosphere on or in the immediate vicinity of the site;
- if the accommodation does not meet generally recognized safety standards;
- theft, vandalism, aggression, drug use, insulting expressions regarding race, nature, or religion are among the reasons for immediate removal from the grounds.
- If the entrepreneur desires interim termination and evacuation, they must inform the guest by personally delivered letter. In urgent cases, the letter can be omitted, and a personal verbal notification suffices.
- After termination, the guest must ensure that their accommodation is evacuated and the grounds are vacated as soon as possible, but no later than within 4 hours.
- If the guest fails to evacuate their accomodation, the entrepreneur is entitled to evacuate the place in accordance with Article 12.2.
- The guest is in principle not entitled to restitution of payment in case of interim termination of the agreement.
Article 12: Evacuation
- The rental accommodations must be empty and vacated by 11:00 a.m. (household waste out, dishes away, rented bed linen removed. The final cleaning must also be completed by 11:00 a.m. and ready for inspection. Keys must be returned to the reception at Pinewood Cabins, Drosbacken 901, 797 92 Idre.
- If the guest does not leave their accommodation, the entrepreneur is entitled, after written notice and observing a period of 7 days from receipt, to evacuate the place at the guest’s expense. The costs of these 7 days, the costs of dismantling, and any storage or disposal costs, insofar as reasonable, shall be borne by the guest.
Article 13: Laws and Regulations
- The guest shall at all times ensure that the accommodation, both internally and externally, meets all environmental and safety requirements that may be imposed by government authorities or by the entrepreneur within the framework of environmental measures for their business.
- LPG installations are only permitted if they are located in motor vehicles that have been approved by the government-designated authority.
Article 14: Maintenance and Construction
- The entrepreneur is obliged to maintain the recreational grounds and central facilities in good condition.
- The guest is obliged to maintain the placed camping accommodation and associated place in the same condition.
- The guest, co-guests, and/or third parties are not permitted to dig on the grounds, cut down trees, prune bushes, install antennas, erect fences or enclosures, or place buildings or other facilities of any kind near, on, under, or around the camping accommodation without prior written permission from the entrepreneur.
- The guest remains responsible at all times for keeping the camping accommodation movable.
Article 15: Liability
- The entrepreneur’s statutory liability for damages other than injury and death is limited to a maximum of 5,000,000 kronor per incident. The entrepreneur is insured for this.
- The entrepreneur is not liable for accidents, theft, or damage on their grounds unless this is the result of a deficiency attributable to the entrepreneur.
- The entrepreneur is not liable for the consequences of extreme weather conditions or other forms of force majeure.
- The entrepreneur is liable for disruptions in their portion of the utilities unless they can invoke force majeure or if these disruptions relate to the line from the guest’s takeover point.
- The guest is liable for disruptions in the portion of the utilities counted from the takeover point unless there is force majeure.
- The guest is liable to the entrepreneur for damage caused by the act or omission of themselves, co-guest(s), and/or third parties, insofar as it concerns damage that can be attributed to the guest, co-guest(s), and/or third parties.
- The entrepreneur commits to taking appropriate measures after notification by the guest of nuisance caused by other guests.
Article 16: Complaints
- A complaint from a guest must always be submitted in writing to the entrepreneur.
- The submission of a complaint has no suspensive effect on the guest’s payment.
- The entrepreneur will assess your complaint and handle it with all reasonableness and fairness. If the guest is not satisfied with this, Swedish law applies.
Article 17: Privacy
- To process your booking, it is necessary to record certain personal data. This includes, among other things: name and address, nationality, and date of birth. This data is stored in a well-secured database. This data may be used by us for internal marketing purposes. Your data will not be provided to third parties.
